Approved VAWA
self-petitioners may be eligible to adjust regardless of their manner of entry
in the U.S. In other words, even if an approved VAWA self-petitioner
entered without inspection ("EWI"), she may still be eligible for adjustment of
status. In addition, there are numerous
other waivers of inadmissibility and deportability that benefit approved VAWA
self-petitioners applying for adjustment of status. For example, an exception to the public
charge ground was added that eliminates the need for an approved VAWA
self-petitioner to submit an affidavit of support. Special provisions also apply to approved
VAWA self-petitioners seeking to adjust status relating to certain criminal
grounds of inadmissibility, prior removal and departure, and fraud or willful
misrepresentation.
