Preference Categories for Qualifying Family Relationships

Preference Immigrants
- First Preference: Unmarried sons or daughters of U.S. citizens (i.e., those who are 21 years of age or older)- 23,400 visas plus unused Fourth Preference;
- Second Preference
- Divided between 2A and 2B categories- 114,200 plus excess over 226,000 plus unused First Preference
- 2A Category- Spouses or children of aliens lawfully admitted for permanent residence - 77% of visas to the 2A category and 75% of the 77% is not subject to per country limitations (2A exempt)
- 2B Category- Unmarried sons or daughters of aliens lawfully admitted for permanent residence
- Third Preference: Married sons or daughters of U.S. citizens - 23,400 plus unused first and Second Preference
- Fourth Preference: Brothers or sisters of U.S. citizens, if such citizens are at least 21 years of age - 65,000 plus any unused 1st and 2nd Preference categories
- Derivative Beneficiaries: The spouse or child of the principal alien under the family-sponsored preferences is entitled to the same status and order of consideration, if accompanying or following to join the spouse or parent.
