What are the Requirements for Mexican Citizens?
A Mexican citizen seeking TN status need not file a petition with USCIS. However, she must obtain a visa in order to enter the U.S. in TN nonimmigrant status. The Mexican citizen can apply for the TN visa at a U.S. embassy or consulate. She must provide the following documentation upon application for the visa:
- Completed and signed Form DS-156 Nonimmigrant Visa Application (note that this form, as well as the DS-157 may only be available on-line depending on the embassy or consulate);
- Completed Form DS-157 Supplemental Nonimmigrant Visa Application, if applicable (required for all males applicants between 16-45, as well as all applicants from certain countries);
- A passport for travel to the U.S. and valid at least six months beyond the intended period of stay in the U.S; and
- Proof of professional qualifications, e.g., original or certified copies of transcripts, certificates, records of previous employment, etc.
Degrees received by the applicant from an educational institution not located within the U.S., Mexico, or Canada must be accompanied by an evaluation by a reliable credentials evaluation service.
After the TN visa has been approved, the Mexican citizen may apply for admission at a U.S. port of entry, a U.S. airport handling international traffic, or a U.S. pre-clearance/pre-flight station. If the U.S. Customs and Border Protection Officer finds the Mexican citizen has met all the requirements, she will be admitted as a TN nonimmigrant and will receive a Form I-94, Arrival/Departure Record, as evidence of her admission. The I-94 will bear the notation "multiple entry" on it, allowing the applicant to enter and exit the U.S. as many times as necessary within the period of stay.
