Similar to the Asylum defense in that the alien must have a fear of persecution on account of race, religion, nationality, or membership in a particular social group or political party. However, this defense has a higher standard of proof. Here, the alien must prove that it is more likely than not that their life or freedom will be threatened if they return to their home country.
