On July 17, 2017, USCIS released a revised version of Form I-9 Employment Eligibility Verification. Beginning September 18, 2017, employers must use the revised form. Until that date, employers may either use the revised form or the previous version from November 14, 2016. The content of the form has not changed, although the form is now three pages instead of two. Additionally, the instructions to the form have changed as follows:
- The "Office of Special Counsel for Immigration-Related Unfair Employment Practices" has been renamed the "Immigrant and Employee Rights Section."
- Section 1 of the form must be completed by the employee no later than "the first day of employment." Prior instructions required completion by the end of the first day of employment, but the phrase "by the end of" has been removed. USCIS has not yet provided an explanation for this change.
- The Consular Report of Birth Abroad (Form FS-240) has been added to List C (documents establishing employment authorization)
- USCIS has restructured and renumbered List C.
