Complex RFE Overcome in I-130 Case

We recently secured I-130 approval after being retained to respond to a complex Request for Evidence (RFE) only a few weeks before the RFE due date. Securing approval was important as a denial would entail the loss of a 2007 priority date in a family-based preference category that currently has a 7-year backlog.  The RFE listed several issues with the documentation submitted, including the lack of a birth certificate that was valid for immigration purposes and the lack of proof concerning a parent-child relationship. It was too late to get an official statement regarding the birth certificate from the jurisdiction where the birth took place. Instead, we submitted an array of other documents along with a clear explanation proving the Beneficiary’s birth and the existence of a parent-child relationship.  The I-130 was approved soon after our submission, putting the Beneficiary one step closer towards her dream of immigrating to the United States.
