Our client had the necessary funds, but the Immigration Service issued a very challenging request for detailed evidence to prove the money was honestly earned. We were able to help the client provide information that was detailed and continuous enough to satisfy the intense scrutiny. The case was approved.<
- A Polish client who had a successful business overseas with an established branch in the U.S. He had invested $60,000 some time previously to effect the successful start up of the U.S. branch, and wished to use this investment as a basis for a nonimmigrant petition. The facts of the business situation made this case a strong one. However, the low level of investment required that we submit extensive supporting documentation. We were able to show the strength of the case in the absence of a large recent investment, and the visa was approved.
- A Dutch company that wished to open a branch in the U.S. and transfer an executive here to oversee startup. We had several problems to overcome. The Immigration Service carefully scrutinizes organizations existing less than six months, making start-up situations challenging. The Service also restricts executives to staff management activities, also challenging in a new office setting. Finally, we had the task of showing the Immigration Service how inventory may be regarded as investment. We were successful at answering all three, and the visa was approved.
