DACA Update 8/31/2018

DACA renewal filings allowed to continue:

A federal judge in Texas, Judge Hanen, has ruled to at least temporarily allow DACA filings to continue. The state of Texas, joined by six other states, had sued the Federal government, claiming that the DACA program begun under President Obama was illegal. Because such lawsuits take time, these states asked Judge Hanen to issue a “preliminary injunction,” which would immediately halt the DACA program while the case was still pending before the Judge. Today, Judge Hanen refused to do that, which means that DACA applications must continue to be accepted. Please be aware that this case is not over, because Judge Hanen has not yet made a final decision about whether he thinks DACA was lawful or not. Unfortunately, the judge hinted that he thinks DACA may be unlawful, which means that he could ultimately decide to end DACA at the end of the trial.

Conclusion:

DACA is safe, at least for now, and for those who wish to renew your DACA, you may do so. Please do pay close attention and check back often for updates. If you would like to discuss your case with an experienced immigration attorney in Chicago, please do not hesitate to contact our office.
