Premium Processing Fees to Increase February 26

On February 26, 2024, Premium Processing fees for Form I-140 (Immigrant Petition for Alien Worker) and Form I-129 (Petition for Nonimmigrant Worker) will rise to $2,805. All cases postmarked on or after that effective date, if requesting premium processing (submitting Form I-907) must include the increased filing fee. The new amount represents a $300 increase from the current fee in these cases. In return, the USCIS will adjudicate submissions within fifteen calendar days, excepting EB-2 National Interest Waiver (NIW) cases, whose premium processing time is forty-five calendar days.
Note that Premium Processing does not guarantee a decision in the designated number of days, just a response, which might be a Request for Further Evidence (RFE). However, once the requested evidence is gathered and submitted, the USCIS will apply the same shortened timeline to issuing the decision.
USCIS offers Premium Processing for a fairly comprehensive range of additional submissions, including from some F-1 students seeking OPT and STEM extensions and from those seeking a change of status to F-1, F-2, M-1, M-2, J-1, or J-2. The promised adjudication period is 30 days; the new fees are $1,685 and $1,965. respectively. However, not every type of case is eligible for premium processing.
