No Abandonment of Permanent Residence

Our client, a permanent resident, came to us because she was placed in removal proceedings for excessive travel outside the United States. After obtaining the client's complete immigration file, we found that despite the excessive travel outside the U.S., she never had the intention of abandoning her residence and had only traveled overseas in order to help set up a nursing degree program in her home country. This project had taken longer than originally expected. Additionally, we found that she had used a reentry permit several times over the time period and had only stopped using it one time due to erroneous advice from an attorney with another firm. We were able to use this error, along with proof of her intent, as well as the fact that our client had a distinguished background and history in the U.S. to request a joint motion to terminate. The joint motion was approved and our client was able to keep her permanent residence.
