U Visa Approval for Victim of Armed Robbery

A young woman came to us for assistance with her legal status. In reviewing her immigration and personal history, we learned that she was a victim of an armed robbery, which could potentially qualify her for a U visa as a victim of a qualifying crime. Our client was concerned that the case might not work since the criminals were never apprehended. However, the regulations only require a showing that the victim is willing to cooperate with the police in investigating the crime, even if the suspects are never caught. Unfortunately, the law enforcement agency with jurisdiction over the crime was not very familiar with the U visa and refused to provide the necessary certification confirming our client's helpfulness in the case. In our efforts to obtain the certification, we worked tirelessly for several months to educate the law enforcement agency about the specifics of the U visa program. Once the certification was secured, we were able to file the client's U visa application, which USCIS has recently approved giving our client lawful status and a path to permanent residence.
